Contents: 1.1 Guangzhou Human Resources and Social Security Bureau Issued Announcement about Annual Examination on Labor Security of 2009 According to the document issued by Guangzhou Human Resources and Social Security Bureau, 2009 annual examination on labor security and Social Security Registration Certificate (¡°the Examination¡±) to employers all over Guangzhou, including each district and county-level city, will be carried out during March to August 2010. The requirements are as follows: (1) For employers which have gone through Social Insurance procedures in Municipal Social Insurance Fund Center, they should go to the municipal authority for labor security annual examination for the Examination. (2) For employers which have gone through Social Insurance procedures in Social Insurance Fund Center in district or county-level city, they should go to the district or county-level city for the Examination. (3) Provincial employers in Guangzhou shall go to the municipal authority for labor security annual examination for the Examination, among which employers directly under provincial, central or army authorities or held by the state should only go to the municipal labor security department for annual examination on Social Insurance Registration Certificate (Adminicle). (4) For newly-established employers, they should declare the annual examination on labor security to labor security supervisory department at various levels and claim the Labor Security Annual Examination Registration Certificate, go through Social Insurance procedures in Social Insurance Agency and receive Social Insurance Registration Certificate. The points of this policy are as follows: (1) Basic Medical Care for urban employees, Basic Medical Care for urban residents and New Rural Cooperation Medical Care can be participated consecutively and will not be affected by floating personnel. (2) The Temporary Measure does not specify whether transferring payment years is allowed, but does specify to establish individual account and the balance of individual account can be transferred. According to Guangzhou Labor Bureau¡¯s notice, governmental fees for foreigners and Taiwan, Hong Kong and Macao natives is adjusted from RMB 9 per person per month to RMB4.5 per person per month, i.e.RMB54 per person per year.
4.1 Guangzhou Local Tax Bureau Issued Forwarding Circular on Extending Tax Policy regarding Laid-off Workers Reemployment According to Forwarding Circular on Extending Tax Policy regarding Laid-off Workers Reemployment issued by Guangzhou Local Tax Bureau on December 21, in order to promote laid-off workers in our province to be reemployed, eligible enterprise can be deducted from the enterprise business tax, city maintenance and construction tax, additional education fees and enterprise income tax with fixed amount base on actual employment numbers in three years under the condition that the enterprises in our province newly employ personnel holding Reemployment Preference Certificate for newly-added post, or personnel eligible to receive Reemployment Preference Certificate according to Guangdong Employment and Unemployment Handbook, and enter into Labor Contract valid for over one year with the aforesaid personnel and pay for their Social Insurance premium. 4.2 Remind: Tax Payers with Annual Income on or above RMB 120, 000 in 2009 Shall Declare Individual Income Tax by Themselves According to Measures for Self Paying and Declaring Individual Income Tax (On Trial) promulgated by the State Tax Administration, tax payers whose total income in 2009 reaches RMB 120,000 or above shall declare it within three months after the ending of the year, no matter whether the income has been levied individual income tax. Therefore people with total income on or above RMB 120,000 in 2009 shall declare individual income tax in local tax authority in charge during Jan. 1 2010 to Mar. 31 2010.

5.2 The State Ministry of Human Resources and Social Security Announced Organizational Rules for Labor and Personnel Disputes Arbitration On Jan.20 2010, the Ministry of Human Resources and Social Security promulgated and implemented Organizational Rules for Labor and Personnel Disputes Arbitration(¡°Organizational Rules¡±).The Organizational Rules will be specialized used for standardizing Organizational institute for labor and personnel disputes arbitration and team construction, and also strengthen resources integration of labor disputes arbitration and personnel disputes arbitration. The characteristics of the Organizational Rules are as follows: (1) It integrates Labor Disputes Arbitration Commission and Personnel Disputes Arbitration Commission, enlarges composition scope for representatives, so as to strengthen construction of Arbitration Commission and leadership of Arbitration Commission to Arbitral cases. The Arbitration Commission is unified named as ¡°Labor and Personnel Disputes Arbitration Commission¡±. (2) It strengthens the importance of Arbitration Commission Agency, stipulates that Labor and Personnel Disputes Arbitration Commission can set substantial agencies to undertake routine work as dealing with arbitral cases for Arbitration Commission.
